Murder counts

I can't seem to give a count to a character that killed me in a house, but if I kill them they can give me a murder count. Is there some issue with fel murder counts?

    did you join the NPC thieves guild at any point? If so, thieves cannot give murder counts
    I tell you the truth, tis better to do 10 damage on the right target than 100 damage on the wrong target.
